Oregon – What To Do If Your RAP Sheet Contains Information About Another Person

Because you must submit fingerprints to obtain your RAP sheet, it is unlikely that it will contain information relating to another person.

If the information on your RAP sheet is incorrect, challenge your record with the Criminal Justice Information Services (CJIS). You can contact the CJIS at (503) 378-3070.

Tennessee – What To Do If Your RAP Sheet Contains Information About Another Person

If you are the victim of mistaken identity or identity theft, challenge your record with the Tennessee Bureau of Investigation (TBI). You must show proof of the mistake and proof of your identity.

Here are the seven steps to correct a mistaken identity on your record:

  1. Call the police department or county sheriff where the error originated to schedule an appointment to get fingerprinted.
  2. Ask the law enforcement agency about the fee in advance so you are prepared.
  3. Go to your appointment to get fingerprinted.
  4. Make copies of documents that prove your identity, such as your driver's license and birth certificate.
  5. Write a short letter telling the TBI about the mistake.
  6. Pay the $24 fee by a cashier's check or money order payable to TBI.
  7. Mail the set of documents with your official fingerprint card to the TBI at the address:

California – What To Do If Your RAP Sheet Contains Information About Another Person

In California, you can petition the court to have someone else’s information removed from your record if you were a victim of identity theft.

Use this Petition for Certificate of Identity Theft to submit to the court:

If you believe that another person has stolen your identity or falsely used your information, you may contact the local law enforcement agency. If someone has used your identity during an arrest, citation, or conviction, you can petition the court for a finding of factual innocence and to have the inaccurate information removed from your record. If the court finds you factually innocent due to identity theft, it will issue an order certifying its determination and may then delete or seal the record.

You will need to file the above petition in court alleging that the incorrect information on your criminal history is because of identity theft.

Connecticut – What To Do If Your RAP Sheet Contains Information About Another Person

If you are the victim of mistaken identity or identity theft, challenge your record with the Connecticut Department of Emergency Services and Public Protection's (DESPP) State Police Bureau of Identification (SPBI). You must show proof of the mistake and proof of your identity.

Here are four steps to challenge your record with the DESPP SPBI:

  1. Report the identity theft or mistaken identity to your local sheriff, police department, or state police headquarters.
  2. Prove your identity to the law enforcement agency with documents such as your driver's license and birth certificate.

Florida – What To Do If Your RAP Sheet Contains Information About Another Person

To correct your criminal record with the Florida Department of Law Enforcement (FDLE), you must show proof of the error by confirming your identity with your fingerprints.

If you think that the error is the result of a mistake, follow the same instructions as those listed in Florida- Fix Your RAP Sheet. Submit the application for a Personal Review record challenge along with your fingerprint card to the FDLE.

If you think the error is the result of identity theft, you should file a claim for "Compromised Identity." Only a law enforcement agency can submit this claim to the FDLE.

Here's how to submit a claim for Compromised Identity:

  1. Get the "Compromised Identity Review Claim Form" at your local police station or download it from the FDLE website.

  2. Complete the form at your local police station and get your fingerprints taken.
  3. Your local police station will submit the form to the FDLE with your fingerprints and any other documentation that you may have that supports your claim.

There is no fee for a Compromised Identity claim. If your fingerprints prove that the record is not yours, the FDLE will work with local law enforcement to remove the wrong information from all criminal records. The FDLE will send you a letter stating the results of your claim and may also send you a certificate verifying your identity. Keep the letter and the certificate with your important papers.

Georgia – What To Do If Your RAP Sheet Contains Information About Another Person

If your identity has been mistakenly matched with another's record, you must submit your fingerprints to GCIC to prove your identity. You can either go to the Georgia Crime Information Center (GCIC) in Decatur or you can ask for a correction by mail.

Illinois – What To Do If Your RAP Sheet Contains Information About Another Person

Illinois recognizes that mistaken identity and identity theft can create false criminal records. For example, someone lies and uses your identity during an arrest, citation, or conviction. Further, a prosecutor may mistakenly file charges against someone else in your name or a court may mistakenly uses your name with a conviction.

Illinois will expunge (erase) a criminal record if a court decides that you have been the victim of identity theft by following the instructions below:

  1. Go to the circuit court where your identity was stolen and see the Circuit Court Clerk.
  2. Fill out the Petition to Expunge and for Judicial Determination of Factual Innocence/Identity Theft Form.

Nevada – What To Do If Your RAP Sheet Contains Information About Another Person

New Jersey – What To Do If Your RAP Sheet Contains Information About Another Person

If you are the victim of mistaken identity or identity theft in New Jersey, you may apply to a court for a judicial determination of innocence.

You are eligible for a judicial determination of innocence if any of the following are true:

  • The person who stole your identity was arrested, cited, or convicted of a crime using your identity;
  • A complaint has been filed in your name but against the person who stole your identity; or
  • Your identity has been mistakenly associated with a conviction record.

If a charge is pending, then the prosecutor can apply for the determination of innocence on your behalf. If it is not pending, then you must apply. There is no fee.

New Mexico – What To Do If Your RAP Sheet Contains Information About Another Person

If you are the victim of mistaken identity or identity theft, challenge your record with the New Mexico Courts. You must petition the court to expunge the inaccurate or incorrect information from your record to the court where your case was heard or the court where you would have heard your case.

Here are the five steps to challenge your record:

  2. Get a copy of your records from the Department of Public Safety. You will need information about the arrest and/or court case, including the date of arrest, arrest number, case number, and more.
  3. Attach your arrest record, public record, and sentencing record to your petition.

  5. File your petition in the appropriate district court.

New York - What To Do If Your RAP Sheet Contains Information About Another Person

In New York, the Division of Criminal Justice Services (DCJS) can help if your name, date of birth or Social Security number has been falsely used by another person.

Take these three steps to clear your name:

  1. Submit details about the arrest event that allegedly includes your identifying information. This includes date(s) of arrest(s), court docket number(s), or other documentation, such as newspaper articles, to identify the arrest so DCJS staff can retrieve the information. You should clearly state that the arrest/event was not you and that you are requesting the information be removed from your RAP sheet.

  2. Download an FBI fingerprint card or contact DCJS to obtain one: RecordReview@dcjs.ny.gov or 518-457-9847 and 518-485-7675. After obtaining the card, you must make an appointment at your local police department or sheriff’s office to have your fingerprints taken.

    You should contact an attorney before getting your fingerprints taken if you think you have any open warrants or immigration issues.

  3. Send your request, all relevant information and fingerprint card to:

Oklahoma – What To Do If Your RAP Sheet Contains Information About Another Person

If you are the victim of mistaken identity or identity theft, challenge your record with the Oklahoma State Bureau of Investigation (OSBI). You must show proof of the mistake and proof of your identity.

Here are the four steps to challenge your record with the OSBI:

  1. Go to the OSBI office in Oklahoma City. The office is located at this address:

  2. Bring your photo ID, either a driver’s license or state ID card.
  3. Get fingerprinted at the OSBI office.

The OSBI will compare fingerprints. If the comparison shows your identity has been wrongly used, they will give you documentation that clears you. The OSBI will contact anyone who asks about your record and will tell them that you are a victim of identity theft.

Oklahoma also offers an "Identity Theft Passport Program." This gives you a certificate and ID card that you may use only for law-enforcement purposes.

Here are the five steps to get the ID Theft Passport:

  1. File an identity-theft report with a law-enforcement agency, such as your local police.
  2. Submit an Order of Expungement through the court to remove the incorrect information from your record. The court clerk can give you the required forms.
  3. Pay the fee. You may need to pay a filing fee.
  4. Complete the Oklahoma “Identity Theft Passport” Application. You can access the form on the OSBI website here: Identity Theft Passport Request.
  5. Mail the expungement order, Identity Theft Passport application, a 2-color passport-style photo, and a copy of your driver’s license or state ID card to this address:

Pennsylvania – What To Do If Your RAP Sheet Contains Information About Another Person

If you are the victim of mistaken identity or identity theft, you must challenge your record with the Pennsylvania State Police (PSP) and show proof of the mistake and proof of your identity. 

Here are the four steps to to challenge your record with the PSP:

  1. Get a copy of the incorrect record from the PSP.
  2. Get your fingerprints taken at an authorized location to prove your identity. For a list of locations, go to the PSP website here: Fingerprinting Service Information.

    Municipal/regional police departments and alternate service providers offer fingerprinting. To find alternate local fingerprinting services available to the general public, conduct an Internet search for “Pennsylvania Fingerprinting Services.” Take your photo ID and your criminal record with you to get fingerprinted.
     
  3. The PSP will review the challenge to your record. You will receive a letter with the results.
  4. Request another copy of your criminal record to confirm that the PSP made the correction.

The state police will not correct the record in these four situations:

  1. You have been arrested or convicted in Pennsylvania.
  2. Two or more people stole your identity.
  3. Your Social Security number was used in the identity theft.
  4. The mistaken identity is caused by a "coincidence"; you and another person have the same name and birth date.

 The only way for you to be sure that a potential employer or landlord gets the corrected record when they do a background check is to show them the letter from the state police.

If the PSP corrects your record for employers and landlords, it will not correct the record for criminal justice purposes. For example, if you are pulled over by police for a traffic infraction, you could be arrested by mistake.

Keep the letter confirming that you are the victim of identity theft with you always. You may need it.

Puerto Rico – What To Do If Your RAP Sheet Contains Information About Another Person

If you are the victim of mistaken identity or identity theft, challenge your record with the Puerto Rico Department of Public Safety. You must show proof of the mistake and proof of your identity.

Here are the five steps to challenge an error on your criminal record certificate:

  1. Call the Puerto Rico Police Department at (787) 793-1234 for instructions on how to proceed.
  2. Go to the court or law enforcement agency where the mistake originated.
  3. Get certified copies of any documents that support your challenge.
  4. Make copies of documents that prove your identity, such as your driver's license and birth certificate. You may have to get fingerprinted. Fingerprinting can be done at any police station.
  5. Go in person or mail your documents including your official fingerprint card to the Puerto Rico Police Department at this address:

South Carolina – What To Do If Your RAP Sheet Contains Information About Another Person

If you are the victim of identity theft or mistaken identity, and there is an offense on your record that you did not commit, you must challenge the record with the South Carolina Law Enforcement Division (SLED) and prove your identity with fingerprints. In general, you will follow the same steps in the section on how to fix your RAP sheet.

Here are the six steps to correct a mistaken identity:

  1. Call SLED at (803) 896-7005 and ask for a "challenge packet." SLED will then mail it to you.
  2. Complete the challenge application.
  3. Get fingerprinted at your local law enforcement agency such as the sheriff's department or police station. Make sure to bring the fingerprint card that was sent in the challenge packet with you to the law enforcement agency.
  4. Make a copy of your photo ID.
  5. Get a money order for $25 payable to SLED if you do not have a copy of your official criminal record.
  6. Send the application, the fingerprint card, the copy of your photo ID, and a copy of your record or the $25 money order in one envelope to the SLED address shown in the challenge packet.

SLED will investigate. If it agrees with your challenge, it will notify all agencies that keep criminal records to make the correction. If SLED denies your challenge, you have the right to appeal within 30 days after you receive the denial. You will have a hearing within 60 days. You should expect the entire process to take several months.

Texas – What To Do If Your RAP Sheet Contains Information About Another Person

If there has been a misuse of your identity and your record contains things you did not do, then you must go to your local law enforcement agency to fix it.

Fixing an identity issue related to your criminal record is a four-step process:

  1. Contact the District Attorney in your county and file an "Application for Expunction;"
  2. Contact the sheriff in your county to file a declaration that your identity was used by someone else without your consent;
  3. Get your fingerprints taken; and
  4. Sign a statement that you did not commit the offense and you did not consent to the use of your identity.

Utah – What To Do If Your RAP Sheet Contains Information About Another Person

If you are the victim of mistaken identity or identity theft, challenge your record with the Utah Bureau of Identification (BCI). In general, the process is similar to the section on how to fix your RAP sheet.

Here are the seven steps to challenge your record with the BCI:

  1. Complete the “Application to Challenge Criminal History Records” form. To access the form and instructions, visit the Utah Department of Public Safety Bureau of Criminal Identification website here: Application and Instructions for Challenging Information Contained on a Criminal History Record.
  2. Get fingerprinted at your local law enforcement agency.
  3. Bring a valid government-issued photo ID, such as a Utah driver’s license. A Utah Driving Privilege Card is not accepted as a valid ID.
  4. Get a copy of your criminal history and highlight the information you wish to challenge. You should provide supporting documentation to show why you believe that information is incorrect.
  5. Pay the $15.00 fee. Acceptable forms of payment include credit card, check, or money order made payable to “Utah Bureau of Criminal Identification”. Do not send cash.
  6. Make copies of everything, including one complete set for yourself.
  7. Mail the original completed application form, supporting documents, payment, and copy of your criminal history to this address:

Virginia – What To Do If Your RAP Sheet Contains Information About Another Person

If you are the victim of mistaken identity or identity theft, you must challenge your record with the Virginia State Police (VSP) Central Criminal Records Exchange (CCRE) and show proof of the mistake and proof of your identity.

Here are the four steps to challenge your record with the VSP:

  1. Report the identity theft or mistaken identity to your local sheriff, police department, or state police headquarters.
  2. Prove your identity to that law enforcement agency using documents such as your driver's license and birth certificate.
  3. Get your fingerprints taken at a law enforcement agency. The person who takes your fingerprints will document in an official letter that they reviewed your personal identification and obtained your fingerprints.
  4. Mail the official letter and your fingerprints to this address:

Washington – What To Do If Your RAP Sheet Contains Information About Another Person

If you are the victim of mistaken identity or identity theft, challenge your record with the Washington State Patrol (WSP). The WSP has a "Compromised Identity Claim" (CIC) program to assist you. The program gives you a letter, a wallet ID card, and a notation on your record showing that you are the victim of identity theft or mistaken identity.

Here are the four steps to correct an error on your record with the Washington State Patrol:

  1. Complete the "Compromised Identity Claim" form. To access the form, visit the WSP website here: Compromised Identity Claim Form.
  2. Get your fingerprints taken at your local police department. 
  3. Submit the CIC form at your local police department when you get fingerprinted. A law enforcement agency must submit the CIC form for you.
  4. Pay the $58 fee. Acceptable forms of payment include a check or money order made payable to the "Washington State Patrol." Send your payment to the following address:

West Virginia – What To Do If Your RAP Sheet Contains Information About Another Person

If you are the victim of mistaken identity or identity theft, challenge your record with the Criminal Identification Bureau (CIB). You must show proof of the mistake and proof of your identity. In general, you will follow the same instructions as those for how to fix your RAP sheet.

Here are the six steps to fix your West Virginia criminal history record:

  1. Go to the court or law enforcement agency where the mistake originated.
  2. Get certified copies of any documents that support your challenge.
  3. Complete the “Challenge of Criminal History Record” form. To access the form, visit the West Virginia State Police website here: Challenge of Criminal History Record.
  4. Pay the $20.00 fee. Acceptable forms of payment include check or money order made payable to “Superintendent, West Virginia State Police”.
  5. Make copies of documents that prove your identity, such as your driver's license and birth certificate.
  6. Mail the completed challenge form, the copies of documents to prove your identity, and payment to this address:

The CIB will investigate and then send you a letter with the results and your documents.

If you are the victim of mistaken identity or identity theft, challenge your record with the Crime Information Bureau (CIB). You must show proof of the mistake and proof of your identity. In general, you can follow the same instructions as those for how to fix your RAP sheet.

Here are the four steps to challenge your record with the CIB:

  1. Complete the Wisconsin Criminal History Challenge form. To access the form, visit the Wisconsin Department of Justice website here: Wisconsin Department of Justice Criminal History Challenge Form.  
  2. Include any documentation proving the error.
  3. Get your fingerprints taken at a local law enforcement agency. The fingerprint card form is FD-258. To see an example, visit the Department of Justice website here: Sample Fingerprint Card.
  4. Make copies of everything for yourself.
  5. Mail the official fingerprint card and original copies of everything to this address:
