New York - Newburgh Ban the Box Law

If you are seeking employment with a government agency in the City of Newburgh, you are covered by its Ban the Box law. The law only applies to the public sector. 

Under this law, an employer cannot ask you any questions about your criminal record on a job application. However, an employer is allowed to ask questions about your criminal record during a job interview. You should be given the chance to explain to the employer in your interview that you have been a law-abiding, deserve consideration, and are qualified for the position.

Before an employer decides to hire you, you will be required to sign a statement declaring if you have ever been convicted of a crime, and if so, under what circumstances. You will also be required to sign a waiver authorizing the city to perform a background check on you after your interview.
