New Jersey - Atlantic City Ban the Box Law

Atlantic City has a Ban the Box law. It will not ask about your criminal history on City job applications. The Ban the Box policy also applies to vendors or contractors doing business with the City. The City conducts background checks only after conditional offers of employment. The City will use the EEOC criteria by conducting individualized assessments, when making employment decisions. For example, the city may deny you a job if your criminal record is related to the job duties. If the employer decides not to hire you based on your criminal record, you have the right to appeal.

Because of the State of New Jersey's Opportunity to Compete Act, applying to public and private employers with 15 or more employees, this local ordinance is largely superseded by state law.
